"Platform" refers to NNN (Nothing. No One. Nobody.), accessible at nnn.nothingholdings.org.
1.2
"Operator" means Nothing Holdings & Ventures LLC, a Wyoming Series LLC ("NHV").
1.3
"AI Personas" include Rena, Rose, Kristin, Devon, Cynthia, El Juez, Diego, Isabella, and Gaia — automated legal content generation systems operating within the Platform.
1.4
"DVK" means Digital Verification Key — NHV's proprietary cryptographic authentication system governing tiered Platform access.
1.5
"NHV Credits" means the Platform's internal currency system governing access to Platform services.
1.6
"User" means any individual or entity accessing or using the Platform.
NNN is an AI-augmented legal technology platform. It is not a law firm. No attorney-client relationship is created through use of this Platform under any circumstances.
2.1
The Platform is an AI-augmented legal technology platform, not a law firm, and does not provide legal representation.
2.2
No attorney-client relationship is created through use of the Platform. Communications with AI Personas do not constitute privileged attorney-client communications.
2.3
AI-generated content is informational only and does not constitute legal advice. Users are solely responsible for obtaining independent licensed attorney review before relying on any Platform-generated content for legal decisions.
2.4
Users assume full responsibility for all actions taken based on Platform content. NHV expressly disclaims liability for consequences arising from User reliance on Platform-generated content without independent legal review.
3.1
Full Platform access requires a valid DVK (Digital Verification Key) issued by NHV. Access tiers are determined by DVK scope classification.
3.2
NHV Credits serve as the Platform's internal currency. Credits are non-refundable and non-transferable except as expressly permitted by NHV.
3.3
Users may not share, transfer, or assign their DVK credentials to any third party. Credential sharing constitutes grounds for immediate termination.
3.4
NHV reserves the right to modify access tiers, DVK scope classifications, and NHV Credit valuations at any time with notice to Users.
4.1
Users must provide accurate, complete, and current information during registration and in all Platform interactions.
4.2
Users shall maintain strict confidentiality of their DVK credentials and immediately notify NHV of any suspected unauthorized access.
4.3
Users agree to use Platform services solely for lawful purposes consistent with these Terms and all applicable federal, state, and local laws.
4.4
Users shall not attempt to circumvent Platform security, reverse-engineer AI Personas, or interfere with Platform operations in any manner.
5.1
NHV retains all rights, title, and interest in and to the Platform, including all AI Personas, Platform-generated content, DVK technology, and associated intellectual property.
5.2
Users may not reverse-engineer, modify, reproduce, distribute, or create derivative works from any Platform component without express written consent from NHV.
5.3 — User Content Ownership
All content submitted by Users to the Platform remains the intellectual property of its creator. By submitting content, Users grant NHV a non-exclusive, royalty-free license to use, store, and process such content solely for the purpose of providing Platform services.
5.4 — Retention
User-submitted content may be retained for the duration of the User's active account and for a period not to exceed three (3) years following account closure, or as otherwise required by applicable law. Users may request deletion of their content at any time subject to Section 9.
5.5 — Confidentiality
NHV maintains confidentiality of all User-submitted content and shall not disclose such content to third parties except as required by law, court order, or with express User consent.
6.1
The Platform is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.
6.2
NHV expressly disclaims all liability for:
- Platform downtime, interruptions, or technical failures
- Accuracy, completeness, or currency of Platform-generated content
- Consequences of User actions taken in reliance on Platform content
- Third-party interactions, services, or content accessed through the Platform
- Unauthorized access to User data resulting from User failure to maintain credential security
6.3
In no event shall NHV's aggregate liability to any User exceed the total amount of NHV Credits purchased by that User in the twelve (12) months preceding the claim.
7.1
These Terms shall be governed by and construed in accordance with the laws of the State of Wyoming, without regard to conflict of law principles.
7.2
Users irrevocably consent to the exclusive jurisdiction of the state and federal courts located in Sheridan County, Wyoming for any disputes not subject to arbitration under Section 10.
8.1
NHV may suspend or terminate User access immediately and without prior notice for violation of these Terms, fraudulent activity, or any conduct NHV determines to be harmful to the Platform, other Users, or NHV's interests.
8.2
Upon termination, User's right to access the Platform ceases immediately. NHV Credits remaining in a terminated account are forfeited unless termination was initiated by NHV without User cause.
8.3
Sections 2, 5, 6, 7, 9, and 10 survive termination of these Terms.
Users of this Platform share intimate legal information. NHV treats that trust as a sacred obligation — not a compliance checkbox.
Data Collection
NHV collects only data necessary to provide Platform services. Collection requires explicit User consent prior to intake. Users will receive clear disclosure of all data categories collected, including personal identifiers and legal matter details. Opt-in mechanisms are required for all categories of sensitive data.
Data Use
User data is used strictly for authorized Platform purposes — service delivery and User support. No secondary use of data occurs without explicit re-consent. Users maintain control over their data usage preferences at all times.
Retention & Deletion
Legal intake matters not in active litigation are retained for 180 days. Completed cases are retained for a maximum of 3 years as required by applicable law. Users may request immediate deletion of their data at any time, subject to verification. Deletion requests are confirmed in writing within 3 business days.
Data Sharing
NHV does not sell User data under any circumstances. Data is not shared with third parties except as required by law or valid court order. Service providers with access to User data are bound by NDA and privacy standards equivalent to these Terms. User consent is required before any discretionary data sharing.
Breach Notification
In the event of a data breach affecting User information, NHV will notify affected Users within 72 hours of discovery. Notification will include the scope of the breach, its impact, and mitigation steps taken. NHV will provide one year of free credit monitoring to all Users whose data was compromised.
User Rights
Users have the right to access their data within 3 business days of request, correct inaccurate data with acknowledgment and timeline, and request deletion with documented confirmation. These rights are exercised by contacting NHV at the address below.
Compliance
This Platform operates in compliance with the California Consumer Privacy Act (CCPA) with clear opt-out mechanisms, and COPPA for any User under 18. Privacy practices are subject to quarterly internal audit and annual policy review.
10.1 — Mandatory Arbitration
Any dispute, claim, or controversy arising out of or relating to these Terms or the Platform shall be resolved by binding arbitration administered by JAMS under its Commercial Arbitration Rules. Arbitration shall be conducted in Sheridan County, Wyoming.
10.2 — Process
Prior to initiating arbitration, the disputing party must provide written notice to NHV at the address below describing the nature of the dispute and the relief sought. The parties shall attempt good-faith resolution for thirty (30) days before arbitration proceeds.
10.3 — Fee Allocation
Each party shall bear its own arbitration costs unless the arbitrator determines that the claim was frivolous or brought in bad faith, in which case fees may be allocated to the prevailing party.
10.4 — Injunctive Relief
Notwithstanding the foregoing, NHV may seek injunctive or other equitable relief in any court of competent jurisdiction to protect its intellectual property or prevent unauthorized use of the Platform.
10.5 — Class Action Waiver
Users waive any right to participate in class action litigation or class-wide arbitration related to the Platform or these Terms.
11.1
The Platform is intended for Users who are 18 years of age or older. By accessing the Platform, Users represent and warrant that they are at least 18 years of age.
11.2
NHV reserves the right to terminate any account upon discovery that the User is under 18 years of age. Such termination shall not entitle the User to any refund of NHV Credits.
12.1
NHV reserves the right to modify these Terms at any time. Material changes will be communicated to Users via email to the address on file and/or prominent Platform notification not less than 14 days prior to the effective date of change.
12.2
Continued use of the Platform following the effective date of any modification constitutes User acceptance of the revised Terms. Users who do not accept modified Terms must discontinue Platform use and may request account closure.
Safe Harbor
NHV operates as a qualifying service provider under the safe harbor provisions of the Digital Millennium Copyright Act (17 U.S.C. § 512). Users agree not to upload, transmit, or distribute content that infringes the intellectual property rights of any third party.

Notice Requirements
A valid DMCA takedown notice must include:
- Physical or electronic signature of the copyright owner or authorized agent
- Identification of the copyrighted work claimed to have been infringed
- Identification of the allegedly infringing material with sufficient information to locate it
- Contact information for the complaining party
- Statement of good faith belief that use is not authorized by the copyright owner
- Statement under penalty of perjury that the information is accurate and the party is authorized to act
Counter-Notice Process
A User whose content has been removed may file a counter-notice within 10 business days. A valid counter-notice must include:
- Physical or electronic signature of the User
- Identification of the removed material and its prior location
- Statement of good faith belief that the material was removed by mistake or misidentification
- Consent to jurisdiction of the federal district court for Sheridan County, Wyoming
- User contact information and statement under penalty of perjury
Repeat Infringer Policy
NHV maintains a three-strike repeat infringer policy:

Written warning issued. Content removed. Account flagged.

Temporary account suspension. Content removed. Review required.

Permanent account termination. Appeal available within 30 days.
Acceptance of Terms
By accessing or using the NNN Platform, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service in their entirety. If you do not agree to these Terms, you must immediately discontinue use of the Platform.
These Terms constitute the entire agreement between you and Nothing Holdings & Ventures LLC with respect to your use of the Platform and supersede all prior agreements, representations, and understandings.
